Anyone of British nationality can apply for a British passport. This means that if you are from England, Northern Ireland, Scotland or Wales you are eligible to submit your application. While there are a variety of reasons for a passport application to be denied, these reasons are all linked to the law. Even if you are only suspected of committing a crime, your passport application might be refused (if an arrest warrant has already been issued).

Being born British is not the only qualifying factor when it comes to attaining a British passport, and there are several legal reasons that may prevent you from getting a new passport. Your passport might be refused or retained in the following situations:

  • If an arrest warrant was issued on your name for being suspected of a serious crime
  • If a court order prohibits you from travelling or holding a British passport
  • If you are out on bail and the terms state that you may not leave Britain
  • If the government paid to have you brought back to Britain and you owe them money
  • If you were the recipient of a United Nations or European Union order that limits travel
  • If there is a court order that prohibits a child from leaving Britain, the child can’t get a passport
  • If your photograph doesn’t meet the requirements

It will be determined whether you are eligible for a British passport during the application process. Be aware that passports can be revoked or cancelled by the government at any moment, so stay out of trouble if you want to keep yours!
