Definitions

• Smartphone-id.com Services or Smartphone-id.com System – A system offered by Smartphone-id.com allowing users to access various professional functions to help manage their identity photos. We verify compliance with administrative standards (ICAO format, photo size/file weight, face position, etc.) for a fee, using AI software followed by a human verification to ensure a photo acceptable to the relevant administration. The compliant product is delivered online and/or by mail. The Smartphone-id.com system may operate through a network of sites under different domain names such as identite.photos, smartphone-id.es, smartphone-id.com, and others offering this service.
• Service Provider or User – A business or individual providing services requiring official standard-compliant identity photos and using the Smartphone-id.com system to take and process online photos.
• Client(s) or Service Purchase(s) – Any person taking a photo online or purchasing a product from a provider with a registered user account in the Smartphone iD system, e.g., a user, student, or client.
• User Account – When a person or company registers on Smartphone-id.com, they get a user account to register service users, service offers, products for sale, create promotions, and other sales-related actions.

User Obligations

By using the Smartphone-id.com system or any affiliated site, you agree:

• Not to violate laws, third-party rights, or our conditions and policies;
• Not to use the site/tools if you are under 18 or legally incapable;
• Not to intercept other users' lists;
• Not to post false, inaccurate, misleading, defamatory content (including personal info), or use the service/site to create or amplify links;
• Not to interfere with comment or rating systems;
• Not to send spam or unsolicited/mass communications, chain letters, or pyramid scheme messages;
• Not to spread viruses or harmful technologies;
• Not to collect users’ data (email, address, card info) without consent.

Acceptable Use and Abuse

Smartphone-id.com is intended solely for providers and companies needing ICAO-compliant identity photos to deliver services (driver’s license, e-visa, travel, etc.). Any other use is prohibited. We respect national standards per country (photo format, size/weight, religious veil rules, etc.).The system must NOT be used for:

• Sending spam;
• Unsolicited emails or SMS;
• Importing client lists not owned or legally obtained by the user.

Reservation pages must NOT be used to:

• Create backlinks to unrelated pages;
• Advertise unrelated activities;
• Charge users without intent to provide service.

Users must treat all client data with respect and confidentiality and may use forms to collect further client info. Report any issue, inappropriate content, or breach of conditions. We ensure images and info do not infringe intellectual property rights; rights holders should contact support with page info.

Inactive or unconfirmed accounts over 24 weeks without login may be cancelled. Accounts causing abnormal system load or violating policy may be modified or closed. We may limit, suspend, or terminate services/accounts and remove content if users cause problems, infringe IP rights, pose legal risks, or breach terms.

Children under 18 cannot create accounts; such accounts will be deleted upon discovery. Parents who find their children created accounts should provide proof to delete them.

Customer Purchase Protection

Buyers and providers share responsibility to ensure transactions using Smartphone-id.com run smoothly. We encourage buyers to communicate with sellers before filing complaints. We’re not liable for abusive orders, services provided or not by providers, even if paid.

In France, there is no right of withdrawal in cases outlined by Article L.221-28 of the Consumer Code for:

• Fully executed service contracts begun with explicit prior consent and waiver of withdrawal;
• Goods made to consumer specifications or personalized;
• Digital content contracts not on physical media, begun with explicit consent and waiver.

By using the service, you waive your right to withdrawal. Once you validate your photo, it is sent for AI then human verification to guarantee compliance for you and the relevant administration.

If the administration rejects the printed photo (e.g., scanning issues), clients may request a refund via email with order number, email, and administration address. Refunds apply only to photos we verified, printed on professional equipment.

Pricing

Smartphone-id.com offers a free limited version. Upgrades incur fees. Companies registering the system may pre-fund a wallet so clients don’t pay directly. All purchases in the system are final and non-refundable. We may display client references on our sites and communication media.

Content and Data

When you upload/use our services, including info about you and your staff, you grant a non-exclusive, worldwide, 10-year, royalty-free, sublicensable right to publish content across the Smartphone-id.com network.

Account, Password, and Security

You can change your password and email in the admin section. You are responsible for password confidentiality and account access. We are not liable for losses due to your breach.

Limitation of Liability

We are not responsible for your content, actions, or omissions, or those of other users. We do not manage transactions between buyers and sellers. We cannot guarantee continuous, secure access to sites/services. We exclude all implied warranties to the extent allowed by law and disclaim liability for monetary loss, reputation damage, customer loss, or direct/indirect damages due to use or inability to use services.

Some jurisdictions do not allow warranty or damage exclusions; those may not apply to you. Our maximum liability is limited to the higher of amounts paid in the last 3 months for services or the price of one service purchased.

Prices are quoted before payment in euros (€), but local currency display may occur, possibly causing exchange fees by your bank.

Terms and Privacy Policy Highlights

• Minimum age 18 or legal majority in purchase country.
• Payment only by credit card and in euros.
• Refund possible only on justified refusal with proof.
• Unlimited attempts to take identity photos.
• Smartphone iD is based in Senegal.
• Verified and paid photos sent in hours by email, days by mail.

Privacy Policy Summary

• Client data stored on secure servers in Europe.
• Data can be deleted on request but then cannot reuse the same email without a new account.
• Data retained to avoid re-entry for quality service.
• Data not shared with other companies but may inform about promotions/services.
• Communication consent given by providing phone/email, may include SMS and calls, with possible costs by carrier. Calls may be recorded for quality.
• You can opt out of calls by contacting support.

Data Usage and Processing

• We collect usage data (email, IP, browser, location, visit duration, pages, etc.) via analytics (Google Analytics or equivalent) for service improvement. Legal basis: legitimate interest.
• We process account registration data for service provision and communication; profile details may include name, photo, contact info.
• Transaction data processed for service delivery and refunds, legal compliance basis.
• Notification subscriptions processed with your consent.
• Correspondence processed for communication, legal basis: legitimate interest.
• Data processed as needed for legal claims, insurance, risk management on legitimate interest basis.
• We disclose data within our group, insurers, payment processor (Stripe), and when legally required.

International Data Transfers

• Data may be transferred outside the European Economic Area (EEA), e.g. to US (Google, Stripe) under privacy shield and standard contractual clauses.
• Our servers are in Belgium, backups on EU-based Google Cloud and Amazon servers. Messaging platforms include Nexmo, Sendinblue, Gmail.
• We use third-party services like Google Analytics, Dialogflow, Google Fonts, Google Maps, MaxMind, Stripe with privacy protections.

Data Retention and Deletion

• Data kept while you are a user; can be modified or deleted by terminating service. Backups retained 30 days.
• Data may be kept longer to meet legal obligations or protect rights/vital interests.

Updates

• We may update this policy; changes take effect once published. Notifications issued via email or site messaging.
• Continued use means acceptance of updated policies.

Your Rights under Data Protection Law

• Access, rectification, erasure, restriction, objection, portability, complaint to authority, withdrawal of consent.
• Two categories of personal data: business data (may include provider info) and client data (service users and buyers).
• Authorized users can access, update, delete, export data. Clients can access and delete their data via account or by contacting [email protected].

Cookies

• Cookies are unique identifier files stored by browsers, either persistent or session-based. They do not usually identify users personally but can be linked to stored personal data.
• We use cookies for authentication, status, advertising (Google Ads/AdWords), analytics (Google Optimize), and consent.
• Providers use cookies including Google Analytics.
• Most browsers let you reject/delete cookies; blocking all cookies may reduce site functionality.

• For EU companies or those processing EU personal data, a subcontracting contract governs responsibilities. By accepting terms, you acknowledge this. By ordering and paying, you accept these terms.

Indemnification

• Service providers and clients mutually release Smartphone-id.com and its affiliates from claims arising from disputes between them. Indemnity does not exceed service cost and requires prior amicable resolution attempt by email.

Policy Amendments

• Changes take effect upon publication on the site. Alerts appear in the top system menu. Use after changes means acceptance.
